Schwarzenegger signs California marijuana decriminalization bill

California Governor Arnold Schwarzenegger signed a bill Friday morning that decriminalizes possession of marijuana in the state.

Those caught with less than an ounce of marijuana will still receive a maximum penalty of $100. However, Senate Bill 1449 reduces the legal categorization of marijuana possession from a misdemeanor to a civil infraction. This means that those caught will not have to appear in court, pay court fees or receive a criminal record.

If it is decriminalized on the federal level, that means that the street cops have no possible way of putting their actions into a legal gray zone as it has been the case with the medicinaries.

So how can the street cops go about this ? Because the street cops dont work on a federal level, they work by the rules set out by the state ? Or so I believe .... ?

So since the street cops are working by the rules set out by the state...can they still say, 'this is illegal on a federal level' and still put the guy in jail for it ? Or do they have to go by this new law now ?

The cops in California go by state laws, only federal authorities could put people in jail. Which they are unlikely to do anyway as they have larger things to worry about than people with less than an ounce of weed.
