Smoking medicinal pot gets terminally ill man evicted

Henderson, NV- A man is facing the option of spending his remaining days on earth, on the streets. His housing complex wants to evict him because of the drugs he uses for his terminal illness. He calls medicinal marijuana a necessity, but because of his prescription his housing complex says he is no longer welcome.

Reggie Morgan has lived at HUD financed Espinoza Terrace for 17 years.

"I like it. I stay to myself and just trying to do the last of my life as stress free as I can with this terminal cancer that I got," he says.

Dealing with liver cancer, Morgan was one of the first people to get a medical marijuana card on advice from his doctor.



"He knew that was the only thing that was helping me," recalls Morgan.

Since then he has grown marijuana plants and smokes about 3 times a day.



"If I take my pills and don't take this, they come right up. The pills make me sick to my stomach," says Morgan.

Recently though, he got a letter from his housing manager saying he's kicked out of his home for "drug-related criminal activity," referring to his use of marijuana.



"When she gave me the notice, I even told her, I don't even have any plants. So ya'll just evicting me because I'm on medical marijuana," he asked.

While medicinal marijuana is legal here in the state of Nevada, the regional housing authority says when they interpret the law, they go by what the federal government says.

"Our policy is zero-tolerance for drugs of any kind irrespective on whether or not they are licensed to use medical marijuana," says Carl Rowe with the Southern Nevada Regional Housing Authority.

HUD in Washington tells Action News, "local housing authorities have the discretion to evict a tenant for using medical marijuana. There's not a HUD or federal regulation that requires eviction."

"You know, I don't want to lose my house and have to worry about my cancer and stuff homeless," laments Morgan.

The Southern Nevada Regional Housing Authority says Reggie Morgan can appeal and changes can be made, but the board will have to hear his case and public opinion before anything is done.
